1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the DriveLab WA website (drivelabwa.com.au) and any driving lessons, courses, or services (“Services”) provided by DriveLab WA (“we”, “us”, “our”), operating in Perth, Western Australia.

By accessing our website, submitting a booking or enquiry, or engaging our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or Services.

2. About DriveLab WA

DriveLab WA is a driving academy providing driving lessons and driver training services, including but not limited to:

3. Eligibility

To book and participate in our driving lessons, you must:

  • Hold a valid learner’s permit, provisional licence, or equivalent, as required under Western Australian driving laws for the lesson type booked
  • Be legally permitted to operate a motor vehicle under supervision in Western Australia
  • Provide accurate and current information when making a booking
  • If under 18 years of age, have appropriate parental or guardian consent where required

It is your responsibility to ensure you meet the legal requirements to receive driving instruction in Western Australia, including holding the correct and current licence documentation.

4. Bookings and Enquiries

  • Bookings for driving lessons may be made via our website, email, or phone.
  • A booking is only confirmed once you receive confirmation from DriveLab WA (via email, SMS, or phone).
  • You are responsible for providing accurate contact and personal details at the time of booking.
  • We reserve the right to decline or reschedule a booking at our discretion, including due to instructor availability, weather conditions, or safety concerns.

5. Cancellations and Rescheduling

  • We require reasonable advance notice for cancellations or rescheduling of a booked lesson. 
  • Cancellations made with insufficient notice may incur a cancellation fee, at the discretion of DriveLab WA. 
  • If DriveLab WA needs to cancel or reschedule a lesson (e.g., due to instructor unavailability, unsafe weather conditions, or vehicle issues), we will notify you as soon as possible and offer an alternative time or a full refund/credit for that lesson.
  • Repeated late cancellations or no-shows may affect your ability to make future bookings.

6. Lesson Packages and Payments

  • Lesson packages may be purchased in advance and are subject to the pricing and terms displayed on our website or as communicated at the time of purchase.
  • Lesson packages are generally valid for use within a reasonable timeframe from the date of purchase.
  • Unused lessons within a package may be subject to our cancellation and refund policy as outlined in these Terms.
  • At present, online payment functionality may not be available directly through our website. Payment methods and processes will be communicated at the time of booking. Should online payment functionality be introduced in the future, payments will be securely processed through a third-party payment provider, and this section will be updated accordingly.
  • All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise stated.

7. Refund Policy

  • Refunds for cancelled lessons or unused portions of a lesson package will be considered on a case-by-case basis, in accordance with the cancellation notice provided.
  • Refunds will not generally be provided for lessons cancelled with insufficient notice, or for missed lessons due to a customer’s failure to attend without notice.
  • Refunds, where approved, will be processed within a reasonable timeframe using the original payment method where possible.
  • This refund policy operates alongside, and does not exclude, any rights you may have under the Australian Consumer Law.

8. Practical Driving Assessment (PDA) Preparation

  • DriveLab WA provides driving lessons and coaching to help prepare learners for the Practical Driving Assessment (PDA).
  • While we make every effort to prepare students to the best of our ability, DriveLab WA does not guarantee a pass result in any PDA or driving test, as the outcome is determined solely by the relevant licensing authority (e.g., Department of Transport WA) and the individual assessor.
  • Booking of the official PDA test is the responsibility of the student/customer, unless otherwise agreed with DriveLab WA.

9. Vehicle Use and Safety

  • All driving lessons are conducted using vehicles provided and maintained by DriveLab WA, unless otherwise agreed.
  • Students must comply with all instructions given by their driving instructor during lessons for safety purposes.
  • Students must hold a valid and appropriate licence/permit for the lesson type booked, in accordance with Western Australian road laws.
  • DriveLab WA reserves the right to terminate a lesson immediately, without refund, if a student behaves in a manner that is unsafe, abusive, or under the influence of drugs or alcohol.

10. Liability and Limitation of Liability

  • DriveLab WA takes reasonable care to provide safe, professional, and high-quality driving instruction.
  • To the maximum extent permitted by law, DriveLab WA is not liable for any indirect, incidental, or consequential loss or damage arising from the use of our Services or website.
  • Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
  • Students acknowledge that driving instruction involves inherent risks associated with operating a motor vehicle, and participate in lessons at their own risk, subject to the duty of care owed by DriveLab WA and its instructors.
  • DriveLab WA maintains appropriate insurance in accordance with Western Australian driving instruction requirements. 

11. Website Use

By using our website, you agree to:

  • Use the website only for lawful purposes
  • Not attempt to gain unauthorised access to any part of the website or its systems
  • Not use the website in any way that could damage, disable, or impair its functionality
  • Provide accurate information when submitting forms or enquiries
